Terms of Service

The rules and conditions that govern your use of the SwiftPOS platform.

Please read these Terms carefully before using SwiftPOS. By creating an account or using the Service, you agree to be legally bound by these Terms.

Acceptance of Terms

These Terms of Service ("Terms") constitute a legally binding agreement between you ("User", "Merchant", or "you") and SwiftPOS Technologies ("SwiftPOS", "we", "our", or "us") governing your access to and use of the SwiftPOS platform, including the web application, APIs, mobile integrations, and all related services (collectively, the "Service").

By clicking "Complete Registration", logging in, or otherwise accessing the Service, you confirm that you have read, understood, and agree to be bound by these Terms and our Privacy Policy.

Eligibility

To use SwiftPOS, you must:

  • Be at least 18 years of age
  • Be a registered business owner, operator, or authorized representative
  • Have the legal authority to enter into this agreement on behalf of your business
  • Provide accurate, complete, and current registration information

SwiftPOS reserves the right to refuse registration or terminate accounts that do not meet these eligibility requirements.

Your Account

3.1 Account Security

You are responsible for maintaining the confidentiality of your login credentials. You agree to:

  • Use a strong, unique password for your SwiftPOS account
  • Not share your credentials with unauthorized individuals
  • Notify us immediately at support@swiftpos.co.tz if you suspect unauthorized access
  • Ensure all staff members added to your account comply with these Terms

3.2 Account Accuracy

You agree to provide accurate and up-to-date information and to promptly update any information that becomes inaccurate. SwiftPOS is not responsible for losses resulting from providing false information.

3.3 One Account Per Business

Each business entity may maintain one merchant account. Multiple branches may be created within a single account. Creating duplicate accounts to circumvent subscription limits is prohibited.

Subscription & Billing

4.1 Trial Period

New accounts receive a free trial period as defined by the selected subscription tier. No payment information is required during the trial. At the end of the trial, access may be restricted until a subscription is activated.

4.2 Subscription Plans

SwiftPOS offers monthly, six-month, and annual subscription plans. Prices are displayed in Tanzanian Shillings (TZS) on the registration and billing pages. All prices are exclusive of any applicable taxes.

4.3 Payment

Subscription payments are processed securely by our payment partner. By providing payment details, you authorize us to charge your chosen payment method for the applicable subscription fee.

4.4 Refunds

Subscription fees are generally non-refundable. If you believe you have been charged in error, contact us within 7 days of the charge at support@swiftpos.co.tz.

4.5 Cancellation

You may cancel your subscription at any time from the billing settings. Cancellation takes effect at the end of the current billing period. Your data remains accessible until the subscription expires.

Acceptable Use

You agree to use SwiftPOS only for lawful business purposes. You must not:

  • Use the Service to process transactions for illegal goods or services
  • Attempt to reverse-engineer, decompile, or access the source code of the platform
  • Introduce malware, viruses, or any harmful code into the Service
  • Use automated tools (bots, scrapers) to extract data from the platform
  • Resell, sublicense, or offer the Service to third parties without written permission
  • Impersonate another user, business, or SwiftPOS representative
  • Violate any applicable local, national, or international law or regulation

Violation of these rules may result in immediate account suspension or termination without refund.

Your Data

You retain full ownership of all business data you enter into SwiftPOS (products, sales, customers, etc.). By using the Service, you grant us a limited, non-exclusive license to store, process, and display your data solely to provide the Service to you.

We will not access your business data for any purpose other than operating the Service, providing support, or as required by law. See our Privacy Policy for full details.

You are responsible for the accuracy and legality of the data you enter. SwiftPOS is not liable for any losses arising from incorrect data entry.

Intellectual Property

The SwiftPOS name, logo, software, interface design, and all related intellectual property are owned exclusively by SwiftPOS Technologies. These Terms do not grant you any ownership rights in the platform.

You may not copy, reproduce, distribute, or create derivative works from SwiftPOS's software or design without explicit written consent.

Service Availability

We aim to provide 99% uptime but do not guarantee uninterrupted access. The Service may be temporarily unavailable due to:

  • Scheduled maintenance (we will provide advance notice where possible)
  • Emergency security patches or system updates
  • Events beyond our reasonable control (force majeure)

We are not liable for any losses resulting from temporary service interruptions.

Limitation of Liability

The Service is provided "as is" and "as available" without warranties of any kind, express or implied. To the maximum extent permitted by law, SwiftPOS Technologies shall not be liable for:

  • Indirect, incidental, or consequential damages arising from your use of the Service
  • Loss of profits, revenue, data, or business opportunities
  • Errors, inaccuracies, or interruptions in the Service
  • Unauthorized access to your account resulting from your failure to secure your credentials

Our total aggregate liability shall not exceed the amount you paid to SwiftPOS in the 3 months preceding the event giving rise to the claim.

Termination

10.1 By You

You may close your account at any time by contacting us. Upon closure, your access to the Service will end. Data deletion follows the schedule outlined in our Privacy Policy.

10.2 By Us

We reserve the right to suspend or terminate your account immediately and without notice if:

  • You breach any provision of these Terms
  • Your subscription payment fails and is not resolved within 7 days
  • We are required to do so by law or court order
  • Continued operation of your account poses a risk to other users or the platform

10.3 Effect of Termination

Upon termination, your right to access the Service ceases immediately. Provisions that by their nature should survive termination (including intellectual property rights, limitation of liability, and governing law) shall continue in effect.

Governing Law

These Terms shall be governed by and construed in accordance with the laws of the United Republic of Tanzania. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts of Dar es Salaam, Tanzania.

If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.
